A BILL to repeal section eight, article five, chapter twenty-eight
of the code of West Virginia, one thousand nine hundred
thirty-one, as amended; and to amend article one, chapter
twenty-five of said code by adding thereto a new section,
designated section twelve, relating to inmates in correctional
institutions; requiring the housing of male and female inmates
separately; and providing for the care of infants born in
correctional institutions.
Be it enacted by the Legislature of West Virginia:

That section eight, article five, chapter twenty-eight of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be repealed; and that article one, chapter twenty-five of
said code be amended by adding thereto a new section, designated section twelve, to read as follows:
ARTICLE 1. ORGANIZATION AND INSTITUTIONS.
§25-1-12. Male and female inmates to be housed separate; infants
born in correctional institutions.
(a) The commissioner shall provide that male and female
inmates are housed separate from each other.
(b) The commissioner of corrections shall provide by policy
for the care of any infant born in a correctional institution, and
shall, as soon as practicable, cause the infant to be removed from
the institution.
NOTE: The purpose of this bill is to clarify that inmates need
only be housed separately in correctional institutions and not kept
separate.
§25-5-8 relating to keeping male and female convicts separate
is repealed. §25-1-12 is new; therefore strike-throughs and
underscoring are omitted.
